Man found in women's outhouse told to get treatment

0706053inside2.jpgCONWAY — Assured that the Maine man discovered at the bottom of an Albany outhouse in June would receive psychiatric treatment, a district court judge accepted a negotiated plea agreement yesterday from Gary Moody, 45.

“Anyone who was in the ladies’ toilet is a victim and females at large are victims and they have heightened scrutiny for fear of what they might find there,” Judge Pamela Albee said. “I think Mr. Moody requires treatment.”

Moody pleaded no contest in the District Court of Northern Carroll County to criminal trespass, stemming from an incident in which he entered a vault under the women’s bathroom at Lower Falls in the White Mountain National Forest.

Authorities found the Gardiner man in the waste vault, wearing waders. He claimed he was looking for his wife’s ring.

Albee accepted the plea, which called for Moody to be fined $1,000 and a $200 penalty assessment. She also ordered him to pay $700 restitution to the U.S. Forest Service and to stay off national forest lands for two years. A 30-day sentence in the Carroll County House of Correction was suspended for two years of good behavior. A disorderly conduct charge was dismissed.

Before accepting the plea, Albee asked prosecutors and Moody’s attorney about what kind of treatment Moody would receive.

“This is a very troubling case and unfortunately, (Moody) was subjected to media scrutiny,” she said. “This settlement is subject to scrutiny and a healthy share of bathroom humor. He deserves compassion. This court can exact punishment and disincentive to ever engage in this offense again.”
